Terms of Service
These Terms govern how schools and their staff use Zion. By creating an account or paying for a subscription, you agree to them.
1. Who we are
Zion is operated by Sipho Yawe ("Zion", "we", "us"). You can reach us at support@zionapp.co.
2. Eligibility and account
You must be at least 18 and have authority to bind your school or organization. Each school is a single tenant ("Organization"). You are responsible for activity under your account and for keeping credentials safe.
3. Subscription, fees and the Founding 50
Zion is a paid software service. Prices and tiers are shown at /#pricing and may change for new sign-ups; we will give you reasonable notice of any change to your current plan. Founding 50 members pay the launch rate for the duration of their plan, on the terms communicated at sign-up.
Fees are charged in advance and are non-refundable except as stated in our Refund Policy. You are responsible for any taxes, duties, mobile-money fees or currency conversion costs.
4. Acceptable use
You agree to use Zion in line with our Acceptable Use Policy. We may suspend access for serious or repeated breaches.
5. Your data and our role
You retain ownership of all data you put into Zion (students, goals, scores, reports). We process it on your instruction to provide the service, in line with our Privacy Policy and Data Processing Agreement. On request we will help you export your data; we delete it within a reasonable period after your subscription ends.
6. Intellectual property
We own the Zion software, brand, and documentation. You get a non-exclusive, non-transferable right to use the service for your school during your subscription. You must not copy, reverse-engineer, resell or sublicense the software.
7. Service availability and changes
We aim for high availability but do not guarantee an uninterrupted service. We may add, change or remove features, and will give reasonable notice before any change that materially reduces functionality on your plan.
8. Warranties and liability
We provide Zion "as is" and disclaim implied warranties to the extent allowed by law. To the maximum extent permitted, our total liability under these Terms is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss (such as lost profit or lost data, where the loss was not reasonably foreseeable).
9. Term and termination
Either party may end the agreement at the end of the current billing period. We may suspend or end your access immediately for serious breach, non-payment, or risk to the service. On termination you may export your data for a reasonable period before deletion.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days in advance. Continuing to use Zion after the change means you accept the updated Terms.
11. Governing law
Governing law and venue are to be finalised by counsel based on the operating entity and your country. Until then, both parties will resolve disputes in good faith.
